The Government has published its Draft Commonhold and Leasehold Reform Bill, outlining major proposals that would reshape residential tenure in England and Wales. The plans include banning most new leasehold flats, easing conversion to commonhold, capping ground rents, and abolishing forfeiture - changes that could significantly alter long‑established lease structures.
Jason spoke with The Negotiator and said that the proposals would effectively rewrite existing lease contracts, transferring value away from freeholders - many of them pension funds - and potentially opening the door to legal challenge. He said “Legislating to change private agreements that have already been entered into, and which form the basis of billions of pounds of institutional investment, will be of significant concern to international investors just as confidence is starting to increase in the UK again.”
